Welcome to Particular Reads! By accessing or using our website (including browsing, creating an account, or purchasing products/services), you agree to these Terms and Conditions. If you do not agree, please do not use the site.

We may modify these Terms at any time. Changes take effect when posted. Your continued use after changes means you accept the updated Terms.

Account Creation and User Responsibilities

The site is intended for individuals 18+ or those using it under the direct supervision of a parent/legal guardian. Use by children under 13 is prohibited.

You agree to provide accurate information, safeguard your credentials, and promptly notify us of any unauthorized use or security incident.

Hybrid Publishing Services Agreement

Ownership of Content and Intellectual Property

We operate a hybrid publishing model. Authors retain all rights to their creative works. By submitting materials, you grant Particular Reads a limited, non-exclusive license to use the content solely to deliver the agreed publishing services (e.g., editing, layout, distribution setup). We do not claim ownership of your content.

Service Descriptions, Payment, and Royalties

We offer services such as editing, layout, design, proofreading, and illustration. Fees are paid by the author and are defined in a separate written agreement. Particular Reads does not take a percentage of back-end sales or royalties.

Royalties from platforms (e.g., Amazon KDP) will be deposited directly into the Publisher’s account and distributed on a scheduled basis, or we will assist the author to submit directly so royalties are paid to the Author. A 2% fee may apply when collected and distributed by the Publisher to cover mailing/handling. We do not guarantee sales performance.

An $80 setup fee is charged for ISBN preparation and submission services (in addition to package fees). We are not an ISBN reseller; this reflects the time to attach/document the ISBN and ongoing maintenance.

Author Obligations and Warranties

You warrant that you own the content and have the authority to grant the license; that it doesn’t infringe others’ rights or violate laws. You agree to indemnify Particular Reads from claims arising from your breach (e.g., IP infringement, defamation).

E-commerce Operations and Transactional Terms

Pricing, Availability, and Order Acceptance

Prices may change without notice. If a pricing error occurs, we may cancel and refund. An order is binding only after payment is processed and we accept/ship the order.

Shipping, Risk of Loss, and Delivery

Provide a correct shipping address. Title and risk of loss pass upon delivery to the carrier. We are not liable for delays/failures outside our control. Shipping is currently limited to the United States.

Return and Refund Policy

Returns are generally limited to our error (e.g., damaged/incorrect item). Requests must be made within 14 days of delivery and items returned in received condition. We may offer store credit or exchange in lieu of refund. Delivery/handling fees are non-refundable.

Loyalty Programs

From time to time, we may offer loyalty programs with program-specific terms (eligibility, accrual, redemption, expiration). Unless stated otherwise, points/credits have no cash value and are non-transferable. We may modify or discontinue programs at any time.

Intellectual Property and Site Content

All site content (text, graphics, logos, images, software) is owned by Particular Reads or its licensors and protected by law. Any use beyond personal, non-commercial use requires our written consent.

DMCA: If you believe your work is infringed, send a notice including: your signature, identification of the copyrighted work, the infringing material’s location, your contact info, and a statement under penalty of perjury that you’re authorized. Email: admin@particularreads.com.

Affiliate Disclosure

We may use affiliate links (e.g., Amazon, IngramSpark). If you buy through these links, we may earn a commission at no extra cost to you. Any transaction or dispute with affiliate purchases is between you and the affiliate partner.

Prohibited Uses and Termination

You agree not to impersonate others, harass, spam, reverse-engineer, or upload unlawful/infringing content. We may warn, suspend, or terminate access for violations.

Disclaimers and Limitation of Liability

Services are provided “as is” and “as available.” We do not warrant uninterrupted or error-free operation. To the extent permitted by law, our total liability to you will not exceed the amounts you paid to Particular Reads in the prior 12 months. We are not liable for indirect, incidental, or consequential damages.

Dispute Resolution; Governing Law

Any dispute will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Rules. Venue: Mooresville, North Carolina. You waive any right to jury trial. These Terms are governed by the laws of the State of North Carolina.

How We Share Information

We share personal information with service providers only as necessary to operate the business (e.g., carriers for shipping; Stripe for payment). We do not sell personal information for money. We use Stripe to process payments. We do not store credit card numbers on our servers. We use reasonable administrative, technical, and physical safeguards to protect data. We will notify users in the event of a breach consistent with applicable law.

Data Retention

We keep personal data only as long as necessary for the purposes described (or as required by law), then delete or de-identify it.

Children’s Privacy

This site is not intended for children under 18, and we do not knowingly collect personal information from children. If a child has provided personal information, contact us and we will delete it.

International Visitors

Our services are intended for U.S. customers. If you access the site from outside the U.S., you consent to the transfer and processing of your data in the United States.
